Subject: 19624/Stop issuance of some building permits Date: Thu, 10 Sep 1992 09:23:00 -0500 RESOLUTION NO. 19624 A RESOLUTION DIRECTING THE OFFICE OF THE CHIEF BUILDING OFFICIAL NOT TO ISSUE CERTAIN BUILDING PERMITS FOR PROPERTIES WHICH FRONT ON HIXSON PIKE FROM THE CITY LIMITS SOUTH TO THE RAILROAD OVERPASS SOUTH OF ADAMS ROAD AND WHICH ARE VACANT, UNDEVELOPED PROPERTIES ZONED FOR OFFICE OR COMMERCIAL USES PENDING RECEIPT OF THE HIXSON PIKE GROWTH CORRIDOR DEVELOPMENT STUDY FROM THE CHATTANOOGA-HAMILTON COUNTY REGIONAL PLANNING COMMISSION AND ACTION THEREON BY THE CITY COUNCIL. ________________________ WHEREAS, The Chattanooga-Hamilton County Regional Planning Commission is conducting the Hixson Pike Growth Corridor Development Study at the request of the City Council in order to provide for orderly development of properties fronting on Hixson Pike from the city limits south to the railroad overpass south of Adams Road; and WHEREAS, pending receipt of said study and action thereon by the City Council there should be a moratorium upon the issuance of building permits on vacant, undeveloped properties zoned for office or commercial uses within said study area; 0C NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, that the Office of the Chief Building Official is hereby directed not to issue any new building permits for properties which front on Hixson Pike from the city limits south to the railroad overpass south of Adams Road and which are vacant, undeveloped properties zoned for office or commercial uses pending the receipt of the Hixson Pike Growth Corridor Development Study and action thereon by the Chattanooga City Council. BE IT FURTHER RESOLVED, that said moratorium set forth in this resolution shall be effective only during the pendency of said study and the effective date of any ordinance relative to said study, but it shall in no event exceed a period of one hundred twenty (120) days. BE IT FURTHER RESOLVED, that any person who has applied for a building permit on property affected by this moratorium and who agrees in writing to comply with the policies and requirements set forth in any ordinance enacted as a result of said Study shall be entitled to the issuance of a building permit subject to the approval of the Chief Building Official.
